Motion Fitness hereby grants and the undersigned Member accepts a Membership entitling the undersigned member the use of Motion Fitness facilities subject to the rules and regulations and operating hours as prescribed for the members from time to time by Motion Fitness.  The total of the payments due to Motion Fitness are as follows:

FOR VALUE RECEIVED, I (we) jointly and severally promise to pay to the order of Motion Fitness the sum of 22.99 dollars biweekly + all applicable taxes for all payments commencing the April 29, 2024. All parties hereto, including co-makers, sureties, guarantors and endorsers severally waive demand and presentment for payment, a notice of nonpayment.

Terms and Conditions

  1. First three days: You may cancel your agreement without any penalty or further obligation in person, provided a signed cancellation is submitted with a request to terminate the agreement within three days of your agreement start date. After those three days, the agreement is no longer fully refundable, and your financial obligation continues whether or not you use the facilities. We sincerely hope you will utilize our facilities. 
  2. 15 Day Customer Satisfaction Guarantee: You may cancel your membership without any penalty or further obligation in person, provided a signed cancellation is submitted with a request to terminate the agreement to Motion Fitness within fifteen days of your membership. The initial fees paid are non-refundable.
  3. Long Distance Change of Permanent Residence: If you move your permanent residence to a city that has Motion Fitness facilities, you will be permitted to train there (pricing will be charged as per the applicable price of that facility).
  4. Membership Card and Access: Scan cards belong to Motion Fitness and any misuse will lead to consequences. 
  5. Membership Changes: Long Distance Change of Permanent Residence: If there are reasonably comparable alternate facilities that are not more than 30 kilometers from your new permanent location, then you will be permitted to train at Motion Fitness honoring our Membership until the end of the Membership. If you move your permanent residence more than 30 km from Motion Fitness and there are no Motion Fitness facilities to service you, you may transfer your Membership to another party (at a cost of $50.00), providing the Membership is in good standing. You are responsible for finding the party to transfer your membership. To be eligible, you must provide us with verification that your new address is a change in your permanent residence. You must pay any arrears on your Account prior to transferring your Membership.
  6. Membership Expiration: If you are paying bi-weekly dues under a one-year Membership, once the Membership expires, you automatically convert to a monthly Membership. At the Anniversary Date of your Membership, and anytime thereafter, you may cancel your Membership by giving us one month written notice. You will be billed for the month after your notice is received by us, and then will be pulled from any future billing.
  7. Time Stops: You may freeze your Membership for up to 12 weeks per calendar year. Time Stop requests must be submitted in writing on the appropriate form to Motion Fitness. To unfreeze your Membership, you must submit written notification, and any Membership that has not been unfrozen by the Member after the freeze period will automatically be unfrozen. The cost to freeze your Membership is $3.00 bi-weekly + GST, and all requests must be given with Seven days written notice. If you freeze your Membership, your Membership is extended by that period, up to 12 weeks. Freeze can only be done in a 2-week increment.
  8. Billing: If your account is 90 days delinquent or your automatic bank payment authorization is cancelled for any reason, the entire balance of the Membership becomes due and payable within 15 days. The Member will be liable for payment of all costs incurred by Motion Fitness in the collection of past due obligations. Motion Fitness charges a $30.00 administration fee each bi weekly if payments are late or returned for any reason.

    Tanning (if included in your membership): Having been advised and fully informed by Motion Fitness concerning the nature of the sun tanning process proposed to be administered including the effects of such process and the possible risks and consequences of exposure to the indoor sun tanning equipment used in such process. I hereby authorize and direct them to administer such indoor tanning process and perform such indoor tanning procedures as may be deemed necessary or advisable. I hereby confirm that no warranty or guarantee, or other assurance, has been made to me covering the results of the indoor sun tanning process, and I hereby relieve them and hold them harmless from all liability for injury or damage that may occur to me. I fully understand the administration of the indoor sun tanning process, including possible adverse skin reaction, side effects, or other possible complications. It is understood that this CONSENT is being given in advance of any administration of the process, and is being given by me voluntarily to induce them to exercise their best judgement as to the manner and requirement of administering the sun tanning process, and procedures to me.
    1. I have read, understand and fully agree to the foregoing CONSENT
    2. The proposed indoor sun tanning process has been satisfactorily explained to me and I have all the information I desire and
    3. I, hereby give my authorization and consent: This CONSENT shall stand as long as I tan with any Motion Fitness location now and in the future.
    4. I am over 18 years of age as per Youth Tanning Legislation (November 1st 2015). Individuals under the age of 18 are NOT permitted to tan by law.
    5. I have read the instructions for proper use of the tanning facilities and do so at my own risk and hereby release the owners, operators, franchiser, or manufacturers, from any damage or harm that I might incur due to use of the facilities

It is agreed that Motion Fitness, its owners, agents, employees, successors and licensors shall not be responsible for members’ or their guests’ articles lost or stolen in the gym or damage to any other property, including automobiles and other methods of transportation. In addition, Motion Fitness, its owners, agents, employees, successors and licensors shall not be liable to any member or their guests for the actions, negligence, errors or omissions of another member of this facility or their guests. I acknowledge I have read and understood the agreement and freely consent to its terms.

 

Motion Fitness shall have the right, without invalidating, cancelling or affecting this Membership Agreement, to make changes (including changes in prices, content and terms) to this Membership Agreement at any time without notice to the Member. Notwithstanding the above, Motion Fitness shall use its best efforts to give Members two (2) weeks’ notice of any changes to the Membership Agreement.

Your Rights Under the Consumer Protection Act You may cancel this contract at any time during the period that ends seven (7) business days after the later of the day you receive a written copy of the contract and the day all the services are available. You do not need to give Motion Fitness a reason for cancelling during this period.

 

 

Please consult your physician prior to starting an exercise or fitness program, and prior to using the Facility.

I agree and consent to receiving electronic correspondence and newsletter containing information about my membership, updates and promotions from Motion Fitness at the email provided above and also giving permission to receive text messages to number provided (12/15/21). I understand my consent can be withdrawn at any time.
