FOR VALUE RECEIVED, I (we) jointly and severally promise to pay to the order of Motion Fitness the sum of 24.99 dollars biweekly + all applicable taxes for all payments commencing the April 29, 2024. All parties hereto, including co-makers, sureties, guarantors and endorsers severally waive demand and presentment for payment, notice of nonpayment.

Terms and Conditions

1. 1. First three days: You may cancel your agreement without any penalty or further obligation in person, provided a signed cancellation is submitted with request to terminate the agreement within three days of your agreement start date. After first three days, the agreement is no longer fully refundable, and your financial obligation continues whether or not you use the facilities. 
   2. 15 Day Customer Satisfaction Guarantee: You may cancel your Membership without any penalty or further obligation in person, provided a signed cancellation is submitted with request to terminate the agreement to Motion Fitness within fifteen days of your membership. The initial fees paid are non-refundable.
   3. Physical Disability: If upon a doctor’s order you cannot physically use any aspect of the club because of physical or medical disability, you may freeze your membership at no charge for a minimum of one month to a maximum period of nine months. To process a freeze due to medical disability, we need a doctor’s verification note. You may choose to terminate the agreement if the disability will be for more than six months. If an arrears situation exists, the amount owing must be paid in full before cancellation can occur. Should you return at a later date, you will need to pay the start-up costs once more, as well as membership fee
   4. Long Distance Change of Permanent Residence: If you move your permanent residence to a city that has Motion Fitness facilities, you will be permitted to train there (pricing will be charged as per the applicable price of that facility).
   5. Agreement Termination: At any time, you may cancel your membership for any reason by giving us a 30 day written notice, prior to your next billing date. If the cancelling member is a family add on to a billable member, 30 days’ notice of cancellation will still apply. If an arrears situation exists, the amount owing will remaining applicable and billable. You will be billed for the period of 30 days after your notice is received by us, and then will be pulled from any future billing.    6. Continuous Membership: Once having terminated your agreement, you will need to pay the start-up charges again and new membership premiums to institute a new agreement. Our hope is that you will be an active continuous member. In some cases, it may be less expensive for you to freeze your agreement if you will not be using it for a while, rather than terminating it and incurring the additional costs.
   7. Freezes: You may freeze your Membership for up to 12 weeks per calendar year. Freeze requests must be submitted in writing on the appropriate form to Motion Fitness. To unfreeze your Membership, you must submit written notification, and all Membership freezes must be provided with a start and end date based on the existing payment schedule. The cost to freeze your Membership is $3.00+GST bi-weekly and all requests must be given with a 7 day written notice. Freeze can only be done in 2 week increments, and in the case of a Family membership, a freeze can only be done to the primary person and will apply to all attached memberships.
   8. Billing and Collections: If your account becomes 90 days delinquent or your automatic bank payment authorization is cancelled for any reason, the entire balance of the agreement becomes due and payable within 15 days. The member will be liable for payment of all costs incurred by Motion Fitness in the collection of past due obligations, if payment is returned for any reason, Motion Fitness charges a fee of $30.00. All returned payments are subject to a $30.00 administration fee. Motion Fitness Collection department may attempt at ANY time to collect dishonored payments and outstanding balances.
   9. Membership Card and Access: Scan cards belong to Motion Fitness and any misuse will lead to consequences.
      Membership Changes: Any changes to your membership including billing changes, freezes and exceptions must be provided with 7 days notice. Motion Fitness is not responsible for incurred charges if 7 days notice is not provided. Changes are subject to a $25.00 administration fee. Any billing adjustments ie. double charges will automatically be adjusted against your next applicable payment unless otherwise advised by administration.
   10. Tanning (if included in your membership): Having been advised and fully informed by Motion Fitness concerning the nature of the sun tanning process proposed to be administered including the effects of such process and the possible risks and consequences of exposure to the indoor sun tanning equipment used in such process. I hereby authorize and direct them to administer such indoor tanning process and perform such indoor tanning procedures as may be deemed necessary or advisable. I hereby confirm that no warranty or guarantee, or other assurance, has been made to me covering the results of the indoor sun tanning process, and I hereby relieve them and hold them harmless from all liability for injury or damage that may occur to me. I fully understand the administration of the indoor sun tanning process, including possible adverse skin reaction, side effects, or other possible complications. It is understood that this CONSENT is being given in advance of any administration of the process, and is being given by me voluntarily to induce them to exercise their best judgement as to the manner and requirement of administering the sun tanning process, and procedures to me.

          3. I, hereby give my authorization and consent: This CONSENT shall stand as long as I tan with any Motion Fitness location now and in the future.
          4. I am over 18 years of age as per Youth Tanning Legislation (November 1st 2015). Individuals under the age of 18 are NOT permitted to tan by law.
          5. I have read the instructions for proper use of the tanning facilities and do so at my own risk and hereby release the owners, operators, franchiser, or manufacturers, from any damage or harm that I might incur due to use of the facilities.

It is agreed that Motion Fitness, its owners, agents, employees, successors and licensors shall not be responsible for members’ or their guests’ articles lost or stolen in the gym or damage to any other property, including automobiles and other methods of transportation. In addition, Motion Fitness, its owners, agents, employees, successors and licensors shall not be liable to any member or their guests for the actions, negligence, errors or omissions of another member of this facility or their guests. I acknowledge I have read and understood the agreement and freely consent to its terms.

Motion Fitness shall have the right, without invalidating, cancelling or affecting this Membership Agreement, to make changes (including changes in prices, content and terms) to this Membership Agreement at any time without notice to the Member. Notwithstanding the above, Motion Fitness shall use its best efforts to give Members two (2) weeks’ notice of any changes to the Membership Agreement.

Please consult your physician prior to starting an exercise or fitness program, and prior to using the Facility.

• With online signups you will pay your initial join fee up front and then about 3 days later your dues will follow.
• With the use of a promo code: You will have to pay the initial join fee and the promo amount will come off your first bi-weekly dues. If the promo amount is higher this will be added for you dues until the amount is spent.
