You may unsubscribe or opt-out at anytime to emails or text messages.  By participating in the Program you consent to receive communication from Women's Fitness of Boston electronically including emails and via messages through the WFOB Fitness App powered by Traineize. You acknowledge and agree that all agreements, Notices, disclosures, and other communications that Women's Fitness of Boston provides to you electronically satisfy any legal requirements that the same be in writing.

A welcome email will be provided to set up an account to access the WFOB Fitness App powered by Trainerize once client agrees to the terms & conditions and payment is processed. If included in program, access will be provided to All ZOOM Links and Passwords that are listed in the WFOB Fitness App. The WFOB Fitness App is accessible both via mobile and desktop.

A welcome email will be provided once client agrees to the terms & conditions and processes payment with a login and password  for the Inchargetechnologie app so client may view/print invoices ang agreements, update credit card information and profile details. This is accessible both via mobile and desktop. 



If applicable to program access, a WFOB Google Library of sessions link will be provided via the welcome email. Google account required for access. 


CANCELLATION POLICY

Failure to access the online software program does not relieve the member of their financial obligation. Service agreement can be cancelled within 3 business days of joining. Paid in Full Service agreement (Paid in Full Service Agreement includes the initial 3, 6, 8 or 12 week program duration) is non-refundable after 3 business days. 

For auto renewable agreements, all cancellations requests must be received in writing thirty (30) days prior to next billing date.  Request may be sent to memberservices@womensfitnessofboston.com  Client MUST complete the CANCELLATION REQUEST FORM and CANCELLATION EXIT INTERVIEW to complete the cancellation process. The cancellation request form will be sent via email/text message or via the Fitness App to client. All cancellations are provided an email confirmation that cancellation has been completed. If you have not received a response from your original cancellation request, please contact us within 30 days of your request at 617-227-1221 or via email at memberservices@womensfitnessofboston.com to confirm cancellation request has been received. Women's Fitness of Boston is not responsible for cancellations request sent to an incorrect email address or email requests not received. 

CHANGES TO MEMBERSHIP TYPE

REQUEST TO CHANGES IN MEMBERSHIP TYPE MUST BE MADE IN WRITING VIA EMAIL REQUEST TO memberservices@womensfitnessofboston.com 14 day prior to next billing date. ALL changes are not in effect until member has agreed to new terms and conditions and confirmation email has been sent. CANCELLATIONS REQUEST IS NOT CONSIDERED A CHANGE TO MEMBERSHIP TYPE. 



Payments and Balances Due

It is understood that payments will be collected through an electronic funds transfer system using a major credit card, debit card, checking account, or savings account. All uncollected payments due to insufficient funds, problems with accounts, or membership balances past due will be subject to a $10 service charge. Failure to correct these problems within 7 days of being notified will result in the $10 service charge automatically billed and charged to the billing method on file. Failure to correct these problems within an additional 7 days of being notified may result in a suspension of service and will be subjects to a $14.95 reactivation fee. If we do not hear from you within 30 days of being notified, the service may be canceled and we may be forced to place the account in collection. All cancellations received via email are provided an email confirmation that cancellation has been completed. If you have not received a response, please contact the club within 30 days of your request at  617-227-1221 to confirm cancellation request has been received and processed.

For purposes of this  “Event” means the “Group Fitness Classes/Sessions with Women's Fitness of Boston's attended virtually (online), and/or participation in fitness activities, including, but not limited to use of equipment provided by Women’s Fitness of Boston” on any date and time they are presented and all transportation to, from and between any Women’s Fitness of Boston event locations, at any Women’s Fitness of Boston event, and all other activities related to any Women’s Fitness of Boston event and to my participation in any Women’s Fitness of Boston event.  In consideration of the opportunity to participate in the Event, I, the undersigned participant, acknowledge and agree that:


1. ASSUMPTION OF RISK. Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage.  These may result from my own actions or inactions, as well as the actions or inactions of others, the rules of play, and the condition of the facilities and equipment.  Further, there may be other risks not known to me and not reasonably foreseeable at this time.  I have considered the nature and extent of the risks involved, and I voluntarily choose to assume all such risks, both known and unknown, even those risks that result from the negligence of the Released Parties (defined below) or others and assume full responsibility for my participation in the Event.  I consent to treatment in the event of an emergency or other incident in which, in the reasonable judgment of the on-site personnel, I require medical care.  I further agree to pay all costs associated with such medical care and to indemnify and hold harmless the Released Parties from any costs or claims arising from such medical care.

2. RELEASE FROM LIABILITY.
I, for myself and on behalf of my heirs, estate, insurers, successors and assigns, hereby fully and forever release and discharge Women’s Fitness of Boston and the affiliates and subsidiaries of Women’s Fitness of Boston and their respective officers, directors, shareholders, employees, agents, distributors, representatives, contractors, successors, assigns, and insurers, all Event sponsors, advertisers, volunteers, and staff, and all owners or lessors of premises used in connection with the Event (collectively the “Released Parties”) from any and all claims or causes of action I may have for damages for personal or bodily injury, disability, death, loss or damage to person or property relating in any way to the Event, whether arising from the negligence of any or all of the Released Parties or otherwise, to the fullest extent permitted by law. 
 
 
3. AUTHORIZATION TO RECORD AND TO USE RECORDINGS and NAME.I hereby grant to Women’s Fitness of Boston its affiliates, subsidiaries, successors, assigns and licensees (collectively “Women’s Fitness of Boston”) permission to film, photograph, video record and otherwise record my image, voice, avatar, name, biographical data, silhouette, body dimension, shape, posture, or any other aspect of the recording at the Event (collectively the ‘Recording’) and the right, throughout the world, in perpetuity, to register for copyright, to use and to assign and/or license others to use all or any portion of the results thereof (or a reproduction thereof), in all media and in any manner now known or hereafter developed, in connection with the Event or otherwise without any additional consideration. I shall have no right of approval and no legal claim arising out of any use or editing of the Recording or my name.  Women’s Fitness of Boston shall have no obligation to use any of the rights I grant.  I represent that it is not necessary for Women’s Fitness of Boston to obtain permission from or to pay any third party in connection with the rights granted in this paragraph.

4. LICENSE TO USE COMMENTS, FEEDBACK AND IDEAS.
I hereby grant to Women’s Fitness of Boston a perpetual license to use all comments, feedback and ideas I may share with them, without notice, compensation or acknowledgement to me, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.
 

5. ARBITRATION.
In the event of any dispute between me and any of the Released Parties (defined above), such dispute shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (but not its Procedures for Large, Complex Commercial Disputes). The decision of the arbitrator shall be final and binding upon all parties, and judgment upon the award rendered pursuant to such arbitration may be entered in any court of competent jurisdiction.



I acknowledge that Women’s Fitness of Boston has not arranged for nor carries any insurance of any kind for my benefit and that I am solely responsible for obtaining and paying for any health, life, travel, accident, property or other insurance relative to my injuries or any other loss I may sustain while participating in the Event.

 

Buyer represents, warrants, and acknowledges that the buyer is in good physical condition and able to utilize Women's Fitness of Boston equipment and facilities and perform the exercises available at WFOB. Buyer also agrees to use the facilities and equipment of WFOB in a safe and responsible manner, to request of WFOB when appropriate or necessary instruction on the proper use of all equipment, and the proper method of exercises. In addition, buyer agrees to warm-up properly prior to beginning any exercise program and to use the equipment only for the exercises that the piece of equipment was intended for. Buyer also agrees to use caution, common sense and safety when selection the type of machine, exercise, or amount of weight during their workout at Women's Fitness of Boston. Rules, policies, and regulation may be subject to change without notice.

I am willingly having my picture taken and give your permission to use my picture in print, online, or for any other future media/social media and promotional purposes for Women's Fitness of Boston. I agree to be fully responsible for my own participation, and hold WFOB or representatives harmless from any liability from the use of my picture. I also consent the use of my name, picture, and any other information about me that would be beneficial to the purpose of promotion and publicity for Women's Fitness of Boston.


Virtual Personal Training Sessions 


Some Programs includes access to thirty minute personal training sessions. Personal Training Sessions will be available for booking directly with an assigned WFOB Team personal trainer/coach. Client is responsible for contacting Women's Fitness of Boston online or via email or phone to schedule personal training session. All sessions must be reserved/booked online by the client 24 hours in advance.  24 hour notice is required in advance to cancel booking of sessions. Session will be deducted from the client's profile if 24 hour cancellation notice is not provided. Sessions MUST be used weekly and do NOT accrue. Failure to book/register and attend sessions does not relieve client of financial obligation. Sessions are non-refundable and non-transferable. 

Virtual Coaching Meetings 

Some Programs includes access to fifteen minute coaching meetings. Virtual Coaching Meetings are available for booking directly with an assigned WFOB Team personal trainer/coach. Client is responsible for contacting Women's Fitness of Boston online or via email or phone to schedule the session. All sessions must be reserved/booked online by the client 24 hours in advance.  24 hour notice is required in advance to cancel booking of sessions. Session will be deducted from the client's profile if 24 hour cancellation notice is not provided.  Sessions MUST be used within program duration and do NOT accrue. Failure to book/register and attend sessions does not relieve client of financial obligation. Sessions are non-refundable and non-transferable. 




PERSONAL TRAINING LIABILITY WAIVER

 

Please be aware that you have requested the services of a personal trainer/coach who is an independent contractor of Women’s Fitness of Boston, and that Women’s Fitness of Boston is in no way responsible for these services. The personal trainer/coach may, at any point, leave Women’s Fitness of Boston before services are rendered, and your agreement is still active, Women’s Fitness of Boston will do everything we can to help you find another trainer/coach.

 

We recommend that you consult your physician before starting any exercise program. Please feel free to ask your personal trainer/coach any questions you have concerning your fitness and lifestyle goals.

 

I hereby affirm that I am in good physical condition and do not suffer from any mental or physical disability which would prevent or limit my participation in training with an independent contractor (personal trainer) at Women’s Fitness of Boston. I understand that I am participating in a program of strenuous physical activity including but not limited to aerobic dance, weight training, stationary bicycling, and other aerobic and anaerobic conditioning classes and machines offered by Women’s Fitness of Boston

I understand and am aware that strength, flexibility, aerobic and anaerobic exercise including the use of exercise equipment, and any program my trainer/coach may involve me in are potentially hazardous activities. I also understand that fitness activities involve a risk of injury and even death, and that I am voluntarily participating in these activities. I hereby agree to expressly assume and accept any and all risk of injury and death. 

 

In consideration of my participation in training with an independent contractor (personal trainer/coach) at Women’s Fitness of Boston, I, for myself, my heirs and assigns, hereby release Women’s Fitness of Boston, its employees, independent contractors, officers and owners from claims, demands, and any causes of action arising from my participation in any personal training program at Women’s Fitness of Boston or done via virtually (online). I fully understand that I may injure myself as a result of my participation in any personal training program at Women’s Fitness of Boston, and hereby release Women’s Fitness of Boston from any liability now or in the future including but not limited to heart attacks, muscle strains, broken bones, shin splints, back injuries, or soreness, occurring during or after my participation in the personal training program.

 

This agreement constitutes the sole and entire agreement between D-Force Athletics Corporation, dba Women's Fitness of Boston and myself in regards to the personal training program described above. No other agreement exists between us, and Women’s Fitness of Boston has made no representations to me, verbally or in writing, about such personal training program except as stated herein.



RESULTS GUARANTEE SECTION BEGINS HERE: 


In order to be eligible for the WFOB Results Guarantee, Women's Fitness of Boston will guarantee results  provided you follow all of our recommended steps as outlined below. Failure to follow any of the steps will void your results guarantee section of this agreement in it's entirety. *If all steps are followed exactly as outlined below and no results* are achieved (*results include any amount of weight or inches lost), client must continue the below outlined steps and Women's Fitness of Boston will continue the coaching plan for free with the same agreed terms. I agrees to the following:

  • To respond to coach's messages -check in via text message 3-4 times a week via the WFOB
  • Complete all requested "to do" tasks during program. (example: take measurements, before/after photos)
  • Book and attend any scheduled coaching meetings, including nutrition orientation
  • Follow the eating guidelines that will be provided as closely as possible
  • Exercise at least 3 times per week and send workout selfies (Log workouts attended and/or mark as completed in the WFOB Fitness/Trainerize App) 
  • Track food in the WFOB FITNESS APP within 48 hours
  • And OVERALL, put in good effort

If any of the above are not completed during the duration of my program, I understand the the Results Guarantee is no longer in effect and voided in it's entirety.
