RATE RESERVATION FEE PAYABLE

To ensure that our Members maintain their current membership dues, annual rate reservation fees of $20 and $20 will be collected annually on March1 and September1 respectively.

MEMBERSHIP ROLLOVER (AUTO-RENEWAL)

This agreement is auto renewing True. If 'TRUE', then for your convenience and to prevent loss of access to the facility, this agreement will automatically auto-renew on a Bi-Weekly Payment basis once the initial term of 16 Weeks has expired.  If you do not want this membership to auto-renew then it will be your responsibility to cancel this membership at the Club.

CANCELLATION FEE AND REFUNDS

This VIP membership is a "NO CONTRACT" term so as a result there are NO CANCELLATION FEES OR BUY OUT CLAUSES.  SIXTY (60) days notice MUST be given for ALL cancellation requests.  There are no refunds on any agreement payments.

DUES PAYMENTS

Starting on April 16, 2024 the amount of $10 will be deducted Bi-Weekly Payment for a minimum payment duration of 16 Weeks. This agreement is auto renewing True. There will be an admin fee of $49.99. There will be a card fee of $0. All fee's are subject to 5% GST and . All payments are the responsibility of 

NON SUFFICIENT FUNDS

Any dishonoured payments will be subject to an NSF fee billed billed at $25.00 for every declined payment.

AUTHORIZATION AGREEMENT (Please read Carefully)

I (we) authorize WORLD GYM and InCharge Life Processing to process a debit, in paper, electronic or other form in the amount defined in this agreement for the payment information on file.

 BILLING AND RENEWAL

Understand the administration of the agreement for WORLD GYM “the Gym” is conducted by InCharge Life Processing. The services provided by InCharge Life Processing are administrative to the status of membership and do not exceed to the provision of any of the benefits of the membership. No changes are to be made in billing without the express written consent of WORLD GYM. The member may cancel/resign this agreement after the initial membership term has been completed as outline in the membership agreement. Proper cancellation notice must be given AT LEAST 60 DAYS PRIOR to the next monthly dues payment date. I, the member/payee, authorize WORLD GYM to process any defaults that may accrue, whether Membership dues or Personal Training payments, to be processed on the next set pre-authorized payment date stated on my agreement. If unsuccessful after 3 attempts, I acknowledge my agreement including personal information as well as outstanding fees will be sent to a collections company chosen by WORLD GYM. I acknowledge that I will not be able to use the facility or book any Personal Training sessions until all outstanding fees are paid. WORLD GYM may assign authorization agreement upon sale or change control of the business of WORLD GYM upon providing 10 days written notice to me/us.

InCharge Life Processing: I(we) authorize InCharge Life Processing to debit my (our) account on behalf of the payee as indicated on a (VOID) cheque, banking information form, or credit card under the terms and conditions agreed by me (us) with the payee until such time as written notice to the contrary is given. I (we) acknowledge that delivery of my/our authorization to the payee constitutes delivery by me (us) to InCharge Life Processing at which I (we) maintain an account and that such merchant is not required to verify that the payment(s) are drawn in accordance with authorization. The member may revoke this authorization upon providing AT LEAST 60 DAYS NOTICE to WORLD GYM. Termination of this authorization does/may not terminate the agreement for goods and services exchanged. I (we) will notify WORLD GYM or InCharge Life Processing in writing of any changes in the account information or termination of this authorization prior to the next pre-authorized debits. Items charged under any of the following conditions will be reimbursed subject to written notification by me (us) to the branch account within 90 days: A) I (we) never provided authorization to the payee. B) The pre-authorized debit was not drawn in accordance with my (our) authorization. C) My (our) authorization was revoked. D) The debit was posted to the wrong account due to invalid/incorrect account information supplied by In Charge Life Processing. I (we) warrant that all persons whose signature(s) are requested to sign on this account have signed this agreement.

LEAVE OF ABSENCE - FREEZE POLICY

There are NO leaves of absence or freezes permitted with this membership.

ADDITIONAL TERMS AND CONDITIONS

The following as set forth are part of the Membership Agreement and Members are obligated to observe and comply with the same. 

SIGNING IN

All members are required to show a valid WORLD GYM membership card to the front desk attendant each and every time upon entrance to the facility without exception. 

 PROOF OF AGE

Persons may be required to provide valid proof of age prior to purchasing a membership. 

LOST OR STOLEN ITEMS

WORLD GYM is not responsible for the loss or theft or damage to personal property. 

FOOTWEAR

Athletic footwear must be worn in exercise areas at all times. NO STREET SHOES OR SANDALS ARE PERMITTED. 

LOST CARD

The member agree to pay WORLD GYM the sum of $10.00 (+gst) as a fee chargeable in the event a membership card is replaced due to a loss, theft, misplacement or name change. 

CLUB USAGE

Failure of member to use WORLD GYM facilities does not relieve the member/buyer of member’s/buyer’s obligation to make monthly dues payments as outlined in Membership Agreement. 

MEMBERSHIP NOT REFUNDABLE

The member/buyer acknowledges and agrees that WORLD GYM has earned the membership fee and monthly dues payments and that notwithstanding any voluntary withdrawal or proper cancellation, suspension of membership or failure of the member to take advantage of the privileges of membership for any reason whatsoever, the member shall not be at any time entitled to a refund of all or any part of monies paid and shall remain liable for any part thereof not yet paid at anytime. 

MEMBERSHIP NOT TRANSFERABLE

WORLD GYM memberships are not transferable to other people such as Friends or other Clients and also are not transferable to other World Gyms. You may, however work out at other World Gyms while travelling, such visits to be limited to 14 days per year per gym. You must present your current membership card or a World Gym Travel Pass.

CANCELLATION/RESIGNATION BY MEMBER
This Membership Agreement may be cancelled/resigned by giving 60 DAYS WRITTEN NOTICE (once you have completed the term of the agreement) prior to the renewal date or the next Bi-Weekly Payment dues payment date any time thereafter. Should the member choose not to resign the membership at that time, the membership will continue Bi-Weekly Payment without notice (Bi-Weekly Payment dues payments amount would remain the same). In the event the member wishes to cancel/resign his or her membership after the initial required membership term as outlined in the membership agreement, he or she may do so by one of the following:

a) sending a registered letter to WORLD GYM clearly outlining your intent to cancel/resign.

OR

b) cancelling/resigning in person by completing the WORLD GYM cancellation or resignation request form and having the club manager or owner sign the form to authorize the cancellation. Membership cancellation/resignation requests will not be authorized if the member’s monthly dues payments or any or all portions of their membership fee is in arrears, or if the member has not fulfilled his or her initial membership term as outlined in the membership agreement. Cancellation/resignation requests received later than 60 DAYS PRIOR TO THE NEXT MONTHLY DUES payment date will take effect the next calendar month. 
CANCELLATION BY WORLD GYM

And at its sole discretion, and without any or any further notice to the member, World Gym may terminate this agreement and cancel the membership where:

a) the member is guilty of conduct unbecoming a member or in any other respect is in default of any term of or otherwise has breached this agreement, and has not cured such default or breach within 15 days after the member’s receipt of written notice thereof from World Gym; or

b) the member is again guilty of conduct unbecoming a member or commits a further default or breach, and such default or breach or conduct is similar to that of which written notice previously has been given; or

c) the member defaults in any payment due pursuant to this agreement and such default continues for a period of 15 days after written notice of the default and demand for payment; or

d) the member commits a second or other further default in payment. Termination of this agreement pursuant to this clause shall not in any way limit or restrict the right of World Gymto charge any fees accrued prior to termination including any penalties or compensation for loss or damage, or otherwise enforce its rights under the agreement.
RULES AND REGULATIONS

World Gym reserves the right to maintain rules and regulations governing memberships, including but not limited to a Code of Conduct, a breach of which shall constitute conduct unbecoming a World Gym member. All results, regulations and privileges of membership, including but not restricted to membership dues, facilities, services and hours of operation are subject to change at any time without notice in the sole and absolute discretion of WORLD GYM. Any such changes do not in any way affect the provisions of the membership agreement or release the member from any obligation hereunder. (Subject to reasonable changes without advance notice). In consideration of WORLD GYM providing the member with access to the facilities and equipment, the member hereby:

a) releases and forever discharges WORLD GYM, it’s partners, principals and employees from all claims from the member, or his/her executors, administrators, heirs, successors or assigns may have for any injury, including injury resulting in death, or damage howsoever caused (including negligence), and

b) indemnifies WORLD GYM, it’s partners, principals and employees from any liability, losses, damages or expenses arising from injury to persona or damages to property, and

c) agrees to be responsible for any and all damages (caused by the member his/her guest(s) of the premises or equipment to the servicing club.

The undersigned buyer’s (herein referred to as Member) signature hereby acknowledges this membership is purchased in accordance to the terms and conditions contained herein and has not relied on any statements written or oral other than contained herein. I have read and understood all Rollover and Cancellation Policies.
